The Supreme Court, Warhol, Prince and Transformation
When we started One River School, I was particularly interested in creating a “transformative” experience and over the last 10 years I feel that in many ways our unique methods have rolled up into something that has accomplished this goal. When it comes to art making, the term “transformation” is also a particularly interesting one to me because scientists have been able to view images of the brain that demonstrate distinct positive changes in those who work on their spatial and creative problem-solving skills.
The term transformation is at the center of another discussion involving art right now. The Supreme Court is about to hear a case involving Andy Warhol’s silkscreen interpretation of a photograph of Prince. The question is: was it copyright infringement of an existing photograph or did Warhol transform the photograph in such away that it is protected by “fair use” laws?
These issues have appeared in the courts in many different ways over the years from Music to Art and more. The fact that two of the greatest icons in the world of art and music are at the center of this current discussion is fascinating and at the end of the day, we will determine how far one has to go to consider something transformative.
Having said that, we own the trademark to “transforming art education”®, so our claim is now doubly official! LOL!
